Bedsores Cited In Cook County Wrongful Death Lawsuit

One potential form of nursing home neglect occurs when bedsores develop and are not properly treated.  As discussed extensively on this site, neglect in the care of bedsores can lead to a variety of adverse health outcomes, including death.  There have been many cases of alleged nursing home neglect in the Chicago area in which the development and worsening of bedsores are cited.

One recent lawsuit has been filed alleging neglect in the treatment of a nursing home patient who had bedsores and died in 2014.  The nursing home is based in Hinsdale.  The lawsuit, which has been filed in the Circuit Court of Cook County, is summarized in a Cook County Record article of July 24, 2015 titled “Widow files wrongful death lawsuit against nursing home.”

An excerpt from the article:

The suit states that Joseph Koucky was admitted to MC-Hinsdale on Feb. 6, 2014, in stable condition and stayed there until his death on April 27, 2014. Court documents indicate that the defendant breached its duty of care by allowing the patient to develop bedsores and failing to monitor and treat the condition, follow its own policies and provide adequate physical therapy.

Additional details and possible updates concerning this wrongful death lawsuit can be found in a variety of media sources, including the Cook County Record article mentioned above.

Alleged Negligence At Pennsylvania Nursing Homes

The Pennsylvania Attorney General filed legal action against a nursing home operator for negligence, in that it allegedly failed to provide various basic services to nursing home residents.

The legal action and alleged negligence is discussed in a variety of media sources, including the July 2, 2015 Newtown Patch article titled “Legal Action Filed Against National Nursing Home Chain” as well as the July 1 wpxi.com article (with video) titled “Pennsylvania AG sues operator of 14 nursing homes.”

The alleged neglect in nursing home care include various issues that could lead to the development of bedsores, including, as seen in the Patch article mentioned above:

  • Residents at risk for bedsores from not being turned every two hours as required.

An excerpt from the wpxi.com article:

“Defendants’ staffing practices cost residents their dignity and comfort, and jeopardized their health and safety,” the attorney general’s complaint said.

The lawsuit said the parent company of the “enormously profitable” Golden Living facilities was “unjustly enriched” and it asked the court to order payback of that money from the 14 Golden Living centers named in the complaint.

Additional details and possible updates can be seen in a variety of media sources, including the Patch and wpxi.com articles mentioned above.
