Extensive Bedsores In Will County, Illinois Abuse Case

A recent incident involving alleged abuse in the Chicago area involves the victim, a 79-year-old woman, Margaret Kuech, having extensive bedsores.

Pressure Ulcers In Hospitals

The Agency for Healthcare Research and Quality (AHRQ), which is part of the U.S. Department of Health & Human Services, has a page devoted to preventing pressure ulcers in hospitals.

On this page, there are a variety of statistics with regard to pressure ulcers, including the following:

  • More than 2.5 million patients a year suffer from pressure ulcers.
  • 60,000 deaths a year are directly related to pressure ulcers.
  • More than 17,000 annual lawsuits are related to pressure ulcers. It is the second most common claim after wrongful death and greater than falls or emotional distress.

The page also mentions that severe pain can accompany pressure ulcers.

Pressure Ulcers Book And Commentary

Bed Sores Prevention Initiative

Lawsuit Highlights Bed Sores In Alleged Nursing Home Neglect

A nursing home in Texas is being sued by the state for its treatment of patients.  This issue is discussed in the June 19 Star-Telegram article titled “State Sues Arlington nursing home, alleging neglect of patients.”  This article discusses alleged mistreatment of nursing home patients who developed pressure sores.

The state is suing Oakwood Nursing and Rehabilitation in Arlington over allegations that patients with pressure sores did not receive proper treatment, including one man who died of an infection after he was hospitalized.

also:

The lawsuit stated that Oakwood violated licensing requirements by failing to monitor residents for pressure sores, failing to call physicians in a timely manner and not implementing written policies to prevent neglect.

As discussed on this site, complications from bed sores can cause severe injuries, and possibly death.  In the article mentioned above, one of the patients who had bed sores later died from an infection he contracted after having an allegedly untreated bed sore.

Bed Sore Statistics Concerning Illinois “High Risk” Nursing Home Residents

Today (June 19, 2014) a press release for the report titled “Raising Expecations:  A State Scorecard on Long-Term Services and Supports for Older Adults, People with Physical Disabilities and Family Caregivers” was released.   This report is from AARP, The Commonwealth Fund, and The SCAN Foundation.

This report evaluates 26 indicators in five dimensions with regard to long-term care services among home care services, family caregiver settings, and nursing homes, and provides this detail for each state.

This report updates the “2011 LTSS Scorecard.”

With regard to the rating for Illinois, as seen in Exhibit 1 (page 9) Illinois ranks 15th among the states across all five dimensions.

Exhibit 2 (page 11) shows all 26 indicators, as well as statistical information including median values as well as “top” and “bottom” values.

Of particular note is statistics for “high risk” nursing home residents both nationally and for Illinois who have pressure sores (also known as bed sores.)  The report defines “Pressure Sores,” alternately referred to as “Pressure Ulcers,” in the glossary on page 113.

With regard to nursing homes, among the information provided is Exhibit A12 on page 79, in which three aspects are shown for each state.  These aspects are:

  • “Percent of High-Risk Nursing Home Residents with Pressure Sores”
  • “Nursing Home Staff Turnover…”
  • “Percent of Long-Stay Nursing Home Residents Who are Receiving an Anti-Psychotic Medication”

The national value for each of these aspects is (respectively, for the year indicated):

  • 6.2%
  • 39.5%,
  • 21.3%.

The Illinois value for each of these aspects (respectively, for the year indicated):

  • 7.0% (43rd in the nation)
  • 38% (25th in the nation)
  • 25.1% (48th in the nation)

Bed Sores Evident In Cases Of Nursing Home Abuse And Neglect

Bed sores (also commonly called bedsores, pressure ulcers, and pressure sores) are often seen in instances of nursing home abuse and nursing home neglect.  These bed sores have been seen in cases of Chicago nursing home abuse and neglect, in other Illinois nursing homes, and throughout the nation.

Recently, there was a $3.3 million jury verdict resulting from a Colorado lawsuit claiming nursing home neglect, in which bed sores are cited.

The Colorado nursing home resident who suffered the alleged negligence was James Sharon, 82.  Last week, a jury verdict awarded $3.3 million, comprised of $300,000 because of negligence and $3,000,000 for punitive damages.

A couple of excerpts from the May 28, 2014 kktv.com article titled “Pueblo Nursing Home Found Guilty Of Negligence, Pays $3.3 Million” :

Belmont Lodge Health Care Center in Pueblo will have to pay millions of dollars to a Southern Colorado man and his family after a jury found the nursing home was negligent in his care.

James Sharon, 82, has lived at the nursing home since 2011. His sister, Alice Franz, says he suffers from mild mental retardation and dementia. Franz says since he was admitted to Belmont Lodge Health Care Center, he developed more health problems.

According to the original complaint filed in 2013, it says her brother suffered from bed sores, dehydration, malnutrition, UTIs, skin tears and abrasions, hyperkalemia (high potassium), multiple infections including E. coli and significant weight loss. After nothing was done to help her brother, Franz was fed up and decided to bring these issues to court.

Illinois Wrongful Death Suit Mentions Bed Sores

There has been a wrongful death lawsuit filed against an Illinois nursing home with regard to the care administered to a nursing home resident (Helen R. Cline) who later died.  Bed sores are mentioned in the lawsuit.

The suit was filed against Eldercare of Alton and Alton Rehabilitation and Nursing Center, as well as Dr. Rajnikant K. Patel.

The suit claims Cline suffered from septic shock, delirium, dehydration, extremely low blood pressure, bed sores, urinary tract infection and an excessive amount of a blood thinner, among other injuries and illnesses.

The suit claims the doctor failed to obtain and document an adequate and complete history about Cline when he assumed responsibility for her medical care.

The article also mentions an investigation by the Illinois Department of Public Health into the treatment of Helen Cline, which issued a report which said the facility failed to provide adequate care.  An excerpt:

“Based on record review and interview, the facility neglected to assess, monitor and implement interventions for a decline in condition for (Cline),” the report said.
